Joe Smith: CSCOPE Decision: Local Control Took a Blow - May 21, 2013
Local control took a blow yesterday . Tom Bowman, Superintendent Corrigan ISD, stated the following in an interview:
"For Dan Patrick to be deciding what's going to be in our curriculum is all at the heart of the problem for me. . . I trust our local community and our local school board. I'll take my chances with my community and with my school board when it comes to making decisions about what we're teaching and how effectively we're teaching it."
Friday was a big day at the capitol. The budget is done now the question moves to Governor Perry -- Will he concur and sign off on it? TX public school supporters participated in an important fight in an effort to restore funding cuts. They managed to restore some funding giving the school people an apparent victory, but in reality the restored money is the same money that was taken away in 2011. The funding battle may not be over as it seems the consensus is moving toward having a special session, but for what it is worth, I think the governor will sign the budget, but he can’t support the move to restore funding.

Senator Dan Patrick, Chair of the Senate Education Committee, is the author and promoter of SB 1406 which is scheduled for debate today on the House floor. I have watched a very small group of people over the past months attempt to create a controversy where none existed. They then have kept the controversy going by continually keeping it in the news, even when the public did not buy the argument.

The districts holding bond elections on Saturday May 11 is now at 89. This is the largest number of school districts having bond elections in several years. I think this says: 1) With the continued student growth in Texas public schools of approximately 80,000 students per year, and with the recent reduction in state funds, there is built up demand for public school facilities and we are seeing some of that demand coming to the bond market. 2) My count currently shows an impressive 80% passage rate. Eighty-nine districts brought propositions to voters; in 72 districts voters approved the propositions.

Mornings after election day at TexasISD are always exceedingly busy and tense. My statements this morning are going to be general. I will get more specific tomorrow or you can see our list on our Lone Finalist website (subscription required) as we continue to update it. This is the largest number of school districts having bond elections in several years. We have confirmed that 79 school districts had bond elections on Saturday, May 11. At this point we know that 47 school districts had propositions approved and 17 school districts had failed propositions; we do not know results for 15 districts. Not all, but many school districts across Texas will hold elections Saturday for voters to choose school board members and decide on bond referendums. Remember, the number of students in Texas public schools has grown and will continue to grow at the rate of approximately 80,000 students per year. Think of it this way: Fort Worth ISD has ADA of 76,400 students, therefore, we need to build facilities equivalent to a Fort Worth ISD each year. Hopefully, these facilities will last 50 years or better and serve thousands of students.

I have pictures in my mind of Florence Shapiro on the Senate Floor with mic in hand, celebrating reforming public education in Texas by adopting an accountability system that included the End Of Course Tests. Yesterday we saw Dan Patrick standing on the Senate Floor celebrating education reform by removing most of the tests and reforming the existing accountability system. I hope you don’t think less of me if I am not totally ecstatic about HB5.

HB 5, originally on Friday’sSenate Intent Calendar,has been moved to today. We will see what happens sometime after 11:00 AM. Educators are staying focused. There has been no action on the TRS Bill SB 1458 while the phone calls and emails continued over the weekend for this legislation that educators believe can give retirees a benefit increase and not reduce active employees benefits. I have been encouraged with the level of participation via phone calls and contacts from both active and retired educators.

Good Morning everyone. I am out of the office today assisting with investment training along with friends Mike Jolly (former Round Rock CFO, now with BOSC) and school finance expert Omar Garcia (also with BOSC). Last night we had dinner together and a full evening of lively discussion centered around school finance - I am looking forward to today.
Bond Update: We have discovered additional school districts putting bond issues before voters on May 11. They are: Comanche, Roscoe, Colorado, Wellman Union and Channing. This brings the total to 65 districts having elections on May 11. Someone asked how many of these are Chapter 41 districts, I will count and let you know.
School districts that find themselves owners of old worn out buildings or growing student populations must have bond elections on one of two election dates (May or November) to address these needs. In the following 60 Texas school districts voters will make the decision as to how to address these issues in their communities on May 11, 2013. Everybody eventually loses with SB 1458, but temporarily the state saves money. It is similar to calculating how much money you could save if you quit eating, buying clothes and paying the rent. It is a perfect example of “throwing the baby out with the bathwater”. This bill is part of the backlash against having government pensions. When our teachers signed their contracts, it came with the expectations that the state of Texas would keep its promises of minimum salary and benefits.

The 30 pieces of silver offered to retired teachers in order to give retired teachers a benefit increase while reducing benefits of active teachers should be rejected. I am hoping to promote interest to generate legislative contacts from active teachers to stop these bills. There are other ways to accomplish these goals without destroying the lives of active teachers. However, note that some organizations say they will not oppose bills that help retirees. I say at what cost?

I do not support the reduction of benefits of active teachers in order to give retired teachers a raise. This is wrong. All current TRS eligible employees should be grandfathered. The Texas Legislature cannot continue to renege on promises made to teachers, this is an unacceptable solution.

Schools Need to take a more broad and deeper look at school safety. Many of our school safety plans that I have seen are very narrow in scope and do not address hazards outside of the school district property. There are many West ISD type accidents just waiting to happen.

Debating an issue that does not exist is not easy, you have to make up all of your facts. There are a few things you can say that may be considered facts, but in the case of the arguments presented yesterday, it was difficult. If you can’t tell, I am like Senator Patrick in that I knew how I felt about vouchers before we started the debate. Senator Patrick does not support public education, therefore, he favors vouchers. Well,he says he does, but his actions speak louder than hiswords. First he creates a voucher bill and gives it a fictitious name (Taxpayer Scholarship Bill) sothe constituency will think it is something else. This does not give me a lot of trust for the other things he says about vouchers.

The House Budget debate that finally passed by 135 to 12 culminated yesterday’s12 hour House session. The numbers will be analyzed and analyzed some more, especially the bipartisan vote of 103 to 43 vote on the voucher amendment. There will be speculationabout what this vote will mean for the future. Honestly, I feel this budget does stretch us go beyond minimum expectations in meeting the needs of our state, especially public schools. Portions of last session’s public education cuts were restored but while schools remain short of the 10/11 funding levels, the funding will be above the 12/13 level. The voucher vote was the highlight of the evening. According to one count, the budget originally included 270 amendments that had to be dealt with.
