Governor Abbott Directs Texas Universities To Ignore President Biden’s Unlawful Title IX Rewrite
Governor Greg Abbott today sent a letter to Texas' public university systems and community colleges directing them to not comply with President Joe Biden's recent revision of Title IX and to refrain from implementing any new system-wide policy related to this revision. "As I have already made clear, Texas will not comply with President Joe Biden's rewrite of Title IX that contradicts the original purpose and spirit of the law to support the advancement of women," reads the letter. "Last week, I instructed the Texas Education Agency to ignore President Biden's illegal dictate of Title IX. Today, I am instructing every public college and university in the State of Texas to do the same. I signed laws to ensure the safety of our students on campus and provide a process for adjudicating reports of sexual harassment and sexual assault with adequate due process for all parties involved, as well as laws to protect the integrity of women's sports by prohibiting men from competing against female athletes—and I will not let President Biden erase the advancements Texas has made." view article

Preventive Law: DOI-ng it Right: Exemptions to Consider in Optimizing Your Local Innovation Plan
At this point we don’t need to impress upon you the meaningful impacts that a well-written District of Innovation (“DOI”) Plan can have on school operations. After nearly ten years of the DOI experiment, it’s no secret that these plans are powerful tools—especially if properly drafted. Whether your District is seeking to adopt a plan for the first time, to renew an expiring plan, or to amend an existing plan, you must ensure that you carefully consider including the latest and greatest exemptions. This quick article will address some of the most popular and emerging innovations worth considering.
Some in Houston facing no power for weeks after storms cause widespread damage, killing at least 4
Harris County Judge Lina Hidalgo says it could take “weeks” for power to be restored in some parts of Houston following fierce storms with winds of up to 100 miles per hour. HOUSTON (AP) — Power outages could last weeks in parts of Houston, an official warned Friday, after thunderstorms with hurricane-force winds tore through the city, knocking out electricity to nearly 1 million homes and businesses in the region, blowing out windows on downtown high rises and flipping vehicles. The National Weather Service said it confirmed a tornado with peak winds of 110 mph (177 kph) touched down near the northwest Houston suburb of Cypress in Harris County. Harris County Judge Lina Hidalgo, the county’s top elected official, said crews were still trying to determine the extent of the damage and the number of casualties from Thursday's storms. Houston Mayor John Whitmire said four people, and possibly five, had died. The story has been updated to correct that school districts across the Houston area canceled classes Friday, not just the Houston Independent School District, and also the spelling of Cypress. view article
A GOP Texas school board member campaigned against schools indoctrinating kids. Then she read the curriculum.
Weeks after winning a school board seat in her deeply red Texas county, Courtney Gore immersed herself in the district’s curriculum, spending her nights and weekends poring over hundreds of pages of lesson plans that she had fanned out on the coffee table in her living room and even across her bed. She was searching for evidence of the sweeping national movement she had warned on the campaign trail was indoctrinating schoolchildren. Gore, the co-host of a far-right online talk show, had promised that she would be a strong Republican voice on the nonpartisan school board. Citing “small town, conservative Christian values,” she pledged to inspect educational materials for inappropriate messages about sexuality and race and remove them from every campus in the 7,700-student Granbury Independent School District, an hour southwest of Fort Worth. “Over the years our American Education System has been hijacked by Leftists looking to indoctrinate our kids into the ‘progressive’ way of thinking, and yes, they’ve tried to do this in Granbury ISD,” she wrote in a September 2021 Facebook post, two months before the election. “I cannot sit by and watch their twisted worldview infiltrate Granbury ISD.” But after taking office and examining hundreds of pages of curriculum, Gore was shocked by what she found — and didn’t find. view article
Humble ISD school board place superintendent on leave amid husband’s scandal
School board members voted to place Superintendent Elizabeth Fagen on paid administrative leave without discussion Tuesday night after a Title IX investigation found her husband, a school employee, guilty of sexual harassment. The Humble ISD school board unceremoniously ousted its superintendent, Elizabeth Fagen, in a 4-2 vote Tuesday night after a Title IX report released last month found her husband, a longtime athletic director in the district, created a hostile and sexually inappropriate work environment. view article

The superintendent of the second largest school district in Texas says, that because of the results of the primary on Super Tuesday, the likelihood of “private school subsidies” being able to pass is very likely. Many GOP lawmakers also tell us they think some form of school vouchers will pass during the next legislative session in January. view article

The government wants to buy their flood-prone homes. But these Texans aren’t moving.
HARRIS COUNTY — After the floodwaters earlier this month just about swallowed two of the six homes that 60-year-old Tom Madigan owns on the San Jacinto River, he didn’t think twice about whether to fix them. He hired people to help, and they got to work stripping the walls, pulling up flooring and throwing out water-logged furniture. What Madigan didn’t know: The Harris County Flood Control District wants to buy his properties as part of an effort to get people out of dangerously flood-prone areas. Back-to-back storms drenched southeast Texas in late April and early May, causing flash flooding and pushing rivers out of their banks and into low-lying neighborhoods. Officials across the region urged people in vulnerable areas to evacuate. view article
Trump, Abbott paint gun rights as imperiled at NRA convention
DALLAS— At the National Rifle Association’s annual convention on Saturday, Donald Trump and Gov. Greg Abbott encouraged the thousands gathered to vote for Trump in the 2024 presidential election as a way to ensure their Second Amendment rights. “The NRA has stood with me from the very beginning, and with your vote, I will stand strong for your rights and liberties,” Trump said. “I heard it a few weeks ago that if gun owners voted, we would swamp them at levels that nobody's ever seen before. I think you're a rebellious bunch, but let's be rebellious and vote this time.” Trump and Abbott spoke to a room packed with NRA members, some of which sported supportive attire from the standard-fare red caps to a dress covered with photos of the former president. During the convention, the NRA released its endorsement for the 45th president, and the Trump political campaign announced the launch for the “Gun Owners for Trump” coalition. view article

Plea for education funding special session rejected by Gov. Abbott
State of Texas: Plea for education funding special session rejected by Gov. Abbott Texas Democrats urged Gov. Greg Abbott to call lawmakers back for a special legislative session Monday, citing “the urgent need to address school finance and improve funding for all of our school districts.” Despite Texas’ record budget surplus, schools face deficits Some of Texas’ largest school districts face significant budget deficits, forcing some to cut teachers and staff for next school year. Democrats blame the cash crunch on the legislature’s failure to increase per-student funding for the public school system in the last legislative session. “We have the resources available to better fund our schools, so we should act,” wrote State. Rep. John Rosenthal, D-Cypress, in the letter. view article

Business manager embezzled Trinidad ISD funds for Disney spree
An Orange man has pleaded guilty to stealing money from the Trinidad Independent School District. On Wednesday, Brandon Delane Looney, 38, pleaded guilty to theft from a program receiving federal funds while serving as business manager for Trinidad ISD. Federal law makes it a crime for someone to steal from an organization receiving more than $10,000 in federal funds annually. According to court documents, Looney embezzled more than $300,000 between 2017 and 2023 while working for Trinidad ISD in Henderson County. Looney used the funds for trips to Walt Disney World and spending sprees at The Disney Store. view article

Austin ISD officials aim to support teachers amid nationwide burnout with new program
Cowan Elementary School teacher Devon Whipple sits in a circle with her fourth grade students on May 9. She puts on a hat shaped like a white bear and instructs her students on what to do next. “Take a deep breath in, arms all the way up, and show me that bear growl,” she says, and in response, about 10 fourth graders give their best growl, finishing off what is a normal occurrence of yoga in Whipple’s classroom. Whipple said yoga is a way to break up the classroom and help motivate her students, a tool she learned through a program called Breathe for Change. The program was introduced to the Austin ISD community to help retain staff as nearly 70% of teachers statewide face burnout and consider leaving the profession, as previously reported by Community Impact. This spring, about 30 AISD teachers across 10 campuses went through the program. view article
Hernandez v. Texas: A 1954 landmark case helped Mexican Americans
Days before the Brown v. Board of Education ruling, another landmark Supreme Court decision granted Mexican Americans in Texas the right to serve on a jury — and opened doors to more civil rights battles. Why it matters: The Hernandez v. Texas ruling in May 1954 affirmed that Mexican Americans were protected under the 14th Amendment and couldn't be excluded from jury duty under Jim Crow laws and practices in Texas. Zoom in: The case involved murder, death threats against attorneys, lawyers forced to use segregated restrooms, and Gus Garcia, the case's star attorney, getting drunk the night before Supreme Court oral arguments. Flashback: Garcia of San Antonio and John J. Herrera of Houston sought to use an alleged murder in Jackson County, Texas, in 1951 as a test case to challenge racist jury policies in Texas. They represented Peter Hernandez, a Mexican American cotton picker accused of fatally shooting another man. Jackson County labeled Mexican Americans as white, and its leaders argued that having an all-white, non-Hispanic jury wasn't discrimination. Between the lines: During a hearing in the murder trial, a judge asked Garcia and Herrera if they would need an interpreter. "No, sir, judge...If you can't understand English or Spanish, perhaps one of my colleagues can interpret for you," Garcia shot back. Still, Garcia and Herrera failed to get Mexican Americans on the jury. The lawyers were also forced to use a restroom outside the courtroom with a sign that said "Hombres Aqui" — a term that became a rallying cry. The all-white jury sentenced Hernandez to life in prison. view article

Cypress-Fairbanks ISD Board Votes to Censor Science Textbooks
It seems germane to preface the following bizarre installment in textbook censorship that Cy-Fair ISD is facing a $138 million budget shortfall for the 2024-2025 academic year. What should have been an innocuous item on textbook adoption after several hard budget decisions took an unexpected turn when a single board member, Natalie Blasingame, led a charge to remove 13 chapters from proposed textbooks covering biology, environmental science, earth systems, health science theory, and principles of education and training. All these textbooks have been adopted by the State Board of Education (a much more conservative body than in years past) and reviewed by district curriculum and instructional staff.
